Cultural Marketing

Incentive Laws
Federal Law No. 8,313, better known as the Rouanet Law, is a mechanism that allows individuals and legal entities to allocate part of their income tax to cultural projects of their choice.
Tax exemption can occur through donation or sponsorship, with the latter allowing the dissemination of advertising from the supporting company linked to the chosen cultural project.
Supporters can be:
Any individual can contribute up to 6% of their income tax.
Any legal entity operating under the "real profit" tax regime can contribute up to 4% of its income tax.
The amount allocated to a cultural project approved by the Ministry of Culture for fundraising through the Rouanet Law may be reduced by up to 100%, depending on the cultural area in which the project falls and the type of support chosen by the company or individual (donation or sponsorship).
Similar to the Rouanet Law, ProAC also allows for tax exemption for supporting companies; however, this is a state law, and the tax to be exempted is the ICMS (Value-Added Tax).
The supporting company can contribute up to 3% of the ICMS (Brazilian state sales tax) due, and the amount donated to any cultural project approved by ProAC ICMS will be 100% deducted from the sponsor's tax.

Rouanet Law

What are the advantages?

What are the risks?
When a company allocates any amount to a project approved under the Rouanet Law, those responsible for the project issue a receipt that will be included in the company's income tax return.
Once the receipt is in the hands of the business owner, the responsibility for monitoring the donated amount falls on the proponent of the cultural project, and no longer on the supporting company. Therefore, the risks of supporting a cultural project covered by the Rouanet Law are minimal.
ProAC ICMS
Similar to the Rouanet Law, ProAC also allows for tax exemption for supporting companies; however, this is a state law, and the tax to be exempted is the ICMS (Value-Added Tax).
The supporting company can contribute up to 3% of the ICMS (Brazilian state sales tax) due, and the amount donated to any cultural project approved by ProAC ICMS will be 100% deducted from the sponsor's tax.
Any company that pays ICMS (a Brazilian state tax) and is up-to-date with its tax obligations can participate as a supporter. Simply register online at www.pfe.fazenda.sp.gov.br . Furthermore, in addition to deducting 100% of the donated amount, the supporting company will have the possibility, as in some cases under the Rouanet Law, of associating its name with the project, generating institutional publicity.
